50 witnesses to testify for Obi, Labour Party in petition against Tinubu’s election

The Labour Party (LP) and its 2023 Presidential Candidate, Peter Obi, have told the Presidential Election Petition Court (PEPC) that they will call no fewer than 50 witnesses to testify in their petition.

LP and Obi are challenging the election of Sen. Bola Tinubu.

Counsel to the petitioners, Prof. Awa Kalu (SAN) said this on Saturday in Abuja at the resumed proceedings of the pre-hearing phase before the court’s five justices.

“We still have a few hiccups at the Independent National Electoral Commission (INEC) because of the order of this court made on March 8, directing the commission to allow us carry out forensic investigation of BVAs which we have not been able to do.”

To this end, Kalu said that his clients would require seven weeks within which to present their petition in court.

The senior lawyer told the court that with regards to timing, his team was suggesting that 30 minutes be allotted to the witnesses classified as “star witnesses” to demonstrate any electronic evidence.

He, however, said that the 30 minutes excluded the time that would be used to demonstrate video evidence or any other electronic evidence.

“For this class of witnesses, they will be cross examined for 30 minutes by each respondent and re-examination will be for five minutes.

“In respect of other witnesses, we suggest 10 minutes for evidence-in-chief, 10 minutes for cross examination by each respondent and five minutes for re-examination.

“For the respondents, we suggest 20 minutes for the evidence-in-chief of their star witnesses, 30 minutes for cross examination and five minutes for re-examination.

“For their other witnesses, we suggest 20 minutes for evidence-in-chief, 15 minutes for cross examination and five minutes for re- examination.

He also suggested that where a respondent called a witness and other respondents wanted to cross examine such a witness, they would have to do so first before the petitioners take their turn.

Counsel to INEC,  Mr Abubakar Mahmoud, SAN, said his client who conducted the disputed election planned to call five witnesses to defend the election of Tinubu.

Mahmoud told the court that his team would require seven days to argue the case of their client.

He said that the commission was proposing 30 minutes for its star witness to give the evidence-in-chief, 15 minutes for cross examination and five minutes for re- examination.

“For the regular witnesses, we propose 10 minutes for evidence-in-chief, 15 minutes for cross examination and five minutes for re-examination.”

He opposed the suggestion by the petitioners that a separate time be given to their expert witnesses for demonstration.

He also said that he was not aware of any hiccups between the petitioner and the commission as was alleged by the counsel to the petitioner.

Mr Roland Otaru, SAN, arguing for Tinubu and Shettima  said that  he would call 21 witnesses to defend his clients challenged victory  excluding expert witnesses.

He requested that all expert reports be front loaded to the respondents within 48 hours.

On timing, he suggested that 20 minutes be allotted to expert witnesses for their evidence-in-chief, 30 minutes for cross examination and five minutes for re-examination.

“For regular witnesses, we suggest 10 minutes for evidence-in-chief, 15 minutes for cross examination and five minutes for re-examination.

Otaru prayed the court to make an order that the schedule of documents to be tendered should be exchanged between parties before the hearing.

For his part, Mr Adeniyi Akintola, SAN, counsel to the All Progressives Congress (APC) said that his client needed only nine days to call its seven witnesses excluding subpoenaed witnesses.

He agreed with  the report of Otaru with regards to timing for each witness.

He, however, said that the petitioners had front loaded only three witness statements and wondered why they would need 49 days to call three witness from only three polling units.

The Chairman of the court, Justice Haruna Tsammani, having heard all arguments urged counsels to meet and reach an agreement on the issue of consolidating the petition.

He adjourned the matter until May 22 for continuation of pre-hearing.

Port Harcourt refinery will be ready before year-end — Kyari

The Group Chief Executive Officer (GCEO) of the Nigeria National Petroleum Company (NNPC) Limited, Malam Mele Kyari, has said the Port Harcourt refinery will be ready before the end of the year 2023, according to a report by Daily Trust.

Kyari said the Port Harcourt refinery (old and new), with a combined capacity of 210,000 barrels per day would have been ready this month but for some supply issues.

He claimed most of the challenges have been addressed and expressed optimism that with the completion of the rehabilitation and the coming on board of the Dangote Refinery in Lagos, Nigerians stand to gain more.

“Our plan is to bring it (Port Harcourt refinery) on stream this month but unfortunately, we have some slippage because of global supply chain issues that we had. We believe that this plant will come on stream before the end of this year. We’re very sure of that. The Port Harcourt refinery has a combination of 210,000 barrels per day so that means it’s a third of the Dangote refinery,” he told Daily Trust.

NNPC has a total refining capacity of 445,000 barrels in four refineries in three locations. 

Kyari said that rather than use public funds, money was borrowed to rehabilitate the refineries and their repayment tied to their performance.

“We’re also borrowing to fix the Warri and Kaduna refinery. Kaduna will kick up, it is a 36 months project but what happens in the rehabilitation is that you do them stage by stage. We will replicate the same thing in the Warri refinery and the contractor, Daewoo is on site working, mobilized to site, equipment being delivered to site and we believe also that within that 36 month cycle, it will also complete the rehabilitation.

“Port Harcourt will start producing fuel this year and by the first quarter of next year, Kaduna will start producing fuel,” the NNPC boss revealed.

Sultan of Sokoto declares Sunday as 1st of Dhul-Qadah 144AH

The Sultan of Sokoto, Alhaji Sa’ad Abubakar, has declared Sunday, May 21, the first day of Dhul-Qadah 1444AH.

The President-General, Nigeria Supreme Council for Islamic Affairs, also confirmed the sighting of the new crescent.

Prof Sambo Junaidu, Chairman of the Advisory Committee on Religious Affairs, Sultanate Council of Sokoto, disclosed this on Saturday.

According to the statement, Dhul-Qadah is one of the four sacred months in Islam; the 11th month on the Islamic calendar comes before the month of Dhul-Hijjah.

“The Sultanate Council Advisory Committee on Religious Affairs, in conjunction with the National Moon Sighting Committee, did not receive any report confirming the sighting of the crescent of Dhul-Qadah 1444AH on Friday.
“Therefore, Saturday, May 20, will be the 30th day of Shawwal 1444AH.

“The sultan has accepted the report and accordingly declared Sunday, May 21, as the first day of Dhul-Qadah 1444AH,” Junaidu said.

Dhul-Qadah, one of the four sacred months in Islam, is the 11th month on the Islamic calendar before Dhul-Hijjah.

The Economic and Financial Crimes Commission (EFCC) has denied allegations of two  million dollars bribe leveled against the Chairman of the Commission, Abdulrasheed Bawa, by Governor Bello Matawalle of Zamfara.

The commission in a statement by its spokesperson, Wilson Uwujiaren, said it “will not be drawn into a mud fight with a suspect”.

Uwujiaren said the attention of the commission was drawn to a trending interview granted to the Hausa Service of the BBC by the governor of Zamfara, where he made the bribery allegations.

According to him, Matawalle’s recourse to an untrue story is symptomatic of a drowning man clutching at straws.

“Despite the irritation of his phantom claims, the commission will not be drawn into a mud fight with a suspect under its investigation for corruption and unconscionable pillage of the resources of his state.

“If Matawalle will be taken seriously, he should go beyond sabre-rattling by spilling the beans – provide concrete evidence as proof of his allegations,” he said.

Uwujiaren said  the public should also be notified about plans by some of the alleged corrupt politically exposed persons to flee the country ahead of May 29.

“The commission is working in close collaboration with its international partners to frustrate these escape plans and bring those involved to justice,” he added.

Farooq A. Kperogi: Buhari’s Last-Minute Provocations of Tinubu

After failing to stop him from emerging as APC’s flag bearer in 2022 and mounting steep hurdles for him in the 2023 election, Muhammadu Buhari increasingly comes across as intentionally charting courses of action designed to provoke pre-inauguration confrontation with Bola Ahmed Tinubu. Or am I missing something?

Take, for example, Buhari’s request to the National Assembly, just days to the end of his term, to approve an $800 million loan for the purpose of distributing “N5,000 per month to 10.2 million, poor and low-income households for a period of six months with a multiplier effect on about 60 million individuals.” This would have been comedic if it weren’t for the tragic, broad daylight official theft that it is.

 Even Senate President Ahmed Lawan whose notoriety for pliancy to the presidency is unmatched in Nigeria’s democratic history couldn’t suppress a hearty burst of laughter when he read Buhari’s request in the Senate. Lawan was particularly tickled by Buhari’s assurance that the dispensation of the money to the poor and the vulnerable in the country would be above board. 

“In order to guarantee the credibility of the process, digital transfers will be made directly to beneficiaries’ account [sic] and mobile wallets,” Lawan quoted Buhari to have said in the letter, which inspired bouts of scornful laughter not just from Lawan but also from other senators. The disdainful giggles suggest that senators knew this was an audacious, unsophisticated, tragicomic attempt at last-minute pillaging of the public till.

Most Nigerians who are so poor that a monthly N5,000 welfare gift will make a difference in their lives have no bank accounts or digital wallets. That was precisely why Buhari’s politically motivated and ill-conceived naira recoloring policy was harder on the desperately poor, particularly in rural areas, than it was on the middle and upper classes. They couldn’t partake in electronic transfers of funds because they had no bank accounts.

Court lifts suspension order on Abure, other, LP officers

Justice Hamza Muazu of a High Court in Abuja on Friday granted an order of stay execution on the suspension of Julius Abure, Chairman of the Labour Party (LP), and others.

Others are the National Organizing Secretary, Clement Ojukwu, and National Treasurer, Oluchi Opara, from parading themselves as LP national officials,

The plaintiffs in the case are Martins Esikpali John; Lucky Shaibu; Isah Zekeri; Omogbai Frank; Abokhaiu Aliu; Ayohkaire Lateef; John Elomah, and Dr Ayobami Arabambi.

They had, in an ex-parte motion, marked M/7082/2023, sought the removal of Abure and the three other national officers of the party, which the judge granted order of suspension

The judge, after listening to arguments from the parties granted the order for stay execution pending the determination of the appeal filed by the defendants.

Justice Muazu had on April 5 issued an interim injunction stopping Abure, Ibrahim, and the party’s National Organizing Secretary, Clement Ojukwu, and National Treasurer, Oluchi Opara, from parading themselves as national officers of LP.

This was contained in an ex-parte motion, marked M/7082/2023, brought before the court by the eight plaintiffs.

At the sitting today, the defendants told the court that they have a notice of appeal pending at the court of appeal.

After much arguments from parties, the judge granted order for a stay on the suspension.

Following the April 5 ex-parte injunction made by Justice Muazu, stopping Abure, Ibrahim, and two other national officials of the party, Alex Ejesieme, SAN, had on April 20 argued that the court lacked jurisdiction to entertain the matter.

The senior advocate had submitted that the matter before the court bordered on the internal affairs of the Labour Party, adding that criminal allegations made by the plaintiffs in the case, could not be ventilated in an origination summon.

He added that the eight plaintiffs that brought the case before the court were not members of the National Executive Council of the party and, as such, lacked the locus standi to institute the case.

According to Ejesieme, “Our contention is very clear that those criminal allegations cannot be ventilated in an origination summon.

“The issue of locus standi is there. When you referred to LP’s constitution, the claimants are not members of NEC or the party.

They have a duty to present their membership cards to the court which they didn’t.”

While objecting to the preliminary objection raised by the counsel for Abure, counsel for the plaintiffs, George Ibrahim, urged the court to dismiss same.

According to him, the first to fourth defendants had yet to obey the April 5 order of the court as they were still parading themselves as national officers of the LP.

With the ruling of the court on having jurisdiction to hear the case, its order of April 5 subsists.

The judge then adjourned until today to hear the substantive case.

Earlier, the plaintiffs had informed the court, through their counsel, Ogwu Onoja SAN, that Abure and the three other national officials allegedly forged several documents of the FCT High Court, including receipts, seal, and affidavits, to carry out unlawful substitutions in the last general election.

Onoja argued that following their indictment by police investigation, the four people are to be arraigned in court, adding that warrants for their arrest have already been obtained. 

Judge denies nullifying Abia governorship election

A Federal High Court denied nullifying the candidature of the Abia  Governor-elect, Dr Alex Otti.

The court, however, said it nullified the election of the candidates for  Kano Labour Party(LP) that contested during the 2023 General Election.

According to reports, a  plaintiff, Ibrahim Haruna-Ibrahim, had filed an application seeking the court to revoke and set aside the certificate of return issued to all LP candidates declared winner in Kano and the 35 states of the Federation, including the FCT Abuja.

The respondents in the suit are: Labour Party and Independent National Electoral Commission.

Justice Muhammad Nasir-Yunusa, said the candidates who participated in the 2023 general election in Abia were not parties before his court.

“This court lacks jurisdiction to make an order for the issuance of certificate of return.

“They are at liberty to seek redress in the appropriate Division of the court” he said

He said INEC was bound to insist receiving the registered members of the first respondent and that of other political parties 30 days before primary election in compliance with section 77(3) of the electoral act 2022.

The section states that a party that has not complied with the section 77(2)(3) of the electoral act 2022 cannot be declared winner of the election.
