Nigerian Government Moves For Death Penalty Against Child Marriage?

A 14-year-old Nigerian girl accused of murdering her 35-year-old husband by putting rat poison in his food could face the death penalty, Nigerian prosecutors said Thursday, according to Agency France-Presse.

The trial of Wasila Tasi’u, from a poor northern Nigeria family, has sparked a heated debate on the role of underage marriage in the conservative Muslim region, especially whether an adolescent girl can consent to be a bride.

Prosecutors at the High Court in Gezawa, outside Nigeria’s second city of Kano, filed an amended complaint that charged Tasi’u with one count of murder over the killing of Umar Sani two weeks after their April wedding in the village of Unguwar Yansoro.
Lead prosecutor Lamido Abba Soron-Dinki said that if convicted, the charge is “punishable with death” and indicated the state would seek the maximum penalty.

Nigeria is not known to have executed a juvenile offender since 1997, when the country was ruled by military dictator Sani Abacha, according to Human Rights Watch.

Tasi’u entered the court wearing a cream-coloured hijab and was escorted by two policemen.

Her parents, who have condemned their daughter’s alleged act, were in the public gallery — the first time the three were in the same room since Tasi’u’s arrest in April, her legal representatives said.

The English-language charge sheet was translated into Hausa for the accused by the court clerk.

Tasi’u refused to answer when asked if she understood the charges.

The case was adjourned for 30 minutes so the charges could be better explained to the defendant, but when the alleged offences were read again Tasi’u stayed silent, turned her head to the wall and broke down in tears.

“The court records (that) she pleads not guilty,” Judge Mohammed Yahaya said, apparently regarding her silence as equal to a denial of the charges and adjourned the case until November 26.

Activists, including in Nigeria’s mainly Christian south, have called for Tasi’u’s immediate release, saying she should be rehabilitated as a victim and noting the prospect that she was raped by the man she married.

But in the north, Islamic law operates alongside the secular criminal code, a hybrid system that has complicated the question of marital consent.

The affected families have denied that Tasi’u was forced into marriage, arguing that girls across the impoverished region marry at 14 and that Tasi’u and Sani followed the traditional system of courtship.

According to Nigeria’s marriage act, anyone under 21 can marry provided they have parental consent and so evidence of an agreement between Tasi’u and her father Tasiu Mohammed could undermine claims of a forced union.

But defence lawyer Hussaina Aliyu has insisted the case is not a debate about the role of youth marriage in a Muslim society.
Instead, she has argued that under criminal law a 14-year-old cannot be charged with murder in a high court and has demanded that the case be moved to the juvenile system.

Nigeria defines the age of adulthood as 17 but the situation is less clear in the 12 northern states under Islamic law, where courts theoretically have the right to consider people under 17 as legally responsible.

Guidelines for how courts should blend Islamic and secular legal codes have not been well defined.

Automatic Ticket For PDP Governors As Jonathan Picks Nomination Form

The Peoples Democratic Party on Thursday  offered automatic second term tickets to all its incumbent governors even as President Goodluck Jonathan picked up the presidential nomination form of the party to contest in the 2015 elections.

The President, who spoke while picking his nomination form at the party’s national headquarters in Abuja, said he would still have bought the nomination form without the endorsement given to him by the national leadership of the PDP.

“I could have still picked the form if they did not give me. But giving me the right of first refusal has attracted more people than ordinarily it would have had.

“Your Excellency, our chairman, thank you and extend our appreciation to other great members of our party, especially members of the NEC who unanimously endorsed that decision.”

He said he was also grateful to the governors, who he said provided N2m for the procurement of the expression of interest form and the N20m for the procurement of nomination form.

“What I can say is to reassure them that I will work with all Nigerians, and I will always maintain that no matter how strong a President is all over the world, the President is only one individual and he alone can’t do everything; he alone cannot change the society.

“For you to succeed, you work with people. So, if you are succeeding, that means we have a team that is working to transform this country. So, I will work with all Nigerians to make sure that we move our country to the next level.”

He said if Nigerians could work together, the country would be great, saying that the whole world was happy with the country with the way it fought the Ebola virus.

The National Chairman of the party, Alhaji Adamu Mu’azu then informed everyone that the party had also decided to extend the right of first refusal to serving governors who wish to run for a second term in office.

“We have decided that our governors and President running for a second term will be given the right of first refusal and all of us know that Mr. President has done so many things.”

‘Aminu Tambuwal Is No Longer Speaker Of The House In The Eye Of The Law’

More troubles await the Speaker of the House of Representatives, Aminu Tambuwal, over his recent defection to the All Progressives Congress, investigation has revealed.

Apart from his security details that were withdrawn by the Nigeria Police Force on Thursday, Tambuwal might be barred from entering either his office or the National Assembly when the House resumes on December 3, PUNCH Newspaper gathered

This was one of the decisions reached during a meeting held by top officials of the Peoples Democratic Party which had in attendance President Goodluck Jonathan.

Tambuwal had on Tuesday adjourned the House till December 3 after he stunned his colleagues by announcing his defection from the PDP to the opposition All Peoples Congress.

But on Thursday, the Police authorities withdrew his security aides, citing section Section 68 (1)(g) of the 1999 Constitution as amended as reason.

The section reads, “A member of the Senate or of the House of Representatives shall vacate his seat in the House of which he is a member if –

(g) being a person whose election to the House was sponsored by a political party, he becomes a member of another political party before the expiration of the period for which that House was elected.”

A top Presidency source told PUNCH on the condition of anonymity that the legal advice before the Federal Government and the leadership of the PDP was that Tambuwal was no longer the speaker of the House in the eye of the law.

He noted that the speaker contravened section (68)(1)(g) by defecting when there is a subsisting court injunction to the effect that there is no division in the PDP.

According to him, the decision to strip Tambuwal of all the rights and privileges of the speaker was taken based on that legal submission.

The source added that the government and the PDP leadership resolved that instead of taking Tambuwal to court for defecting without vacating his seat, he would be the one to go to court when his rights are withdrawn.

He said, “The withdrawal of Tambuwal’s security details is in order. Section 68 (1)(g) made it clear that a lawmaker who defects when there is no division in his party shall vacate his seat.

“The legal advice is that the operational word there is ‘shall.’ That section of the constitution is self-

“There is a subsisting court injunction that there is no division in the PDP and that there is no merger.

“It therefore means that based on that constitutional provision, Tambuwal is no longer a member of the House. Since he is no longer a member, then he cannot be the speaker.

“The withdrawal of his security details is in order. He will even be stopped from entering his office. He is no longer a member of the House.

“Instead of us taking him to court, he will be the one to go to court.”

President Goodluck Jonathan had on Wednesday engaged some leaders of the PDP in a meeting aimed at taking a common position on the matter.

Those who attended the meeting included the National Chairman of the PDP, Adamu Mu’azu; the Deputy Leader of the House, Leo Ogor; as well as governors Gabriel Suswam (Benue); Godswill Akpabio (Akwa Ibom); Seriake Dickson (Bayelsa); Ibrahim Dankwabo (Gombe); and Sullivan Chime (Enugu).

Top governmental officials who also attended the parley were the Secretary to the Government of the Federation, Anyim Pius Anyim; the National Security Adviser, Sambo Dasuki; and the Attorney-General of the Federation, Muhammed Adoke (SAN).

“Donations Won’t Stop” Goodluck Support Group Gets 21 Vehicles From Manufacturer For Campaign

Innoson Vehicles Manufacturing Company Limited on Thursday in Abuja donated 20 buses and a jeep to the Goodluck Support Group (GSG).

The Chairman of the company, Chief Innocent Chukwuma who made the donation, said it was a token to help the GSG carry out its campaign effectively for President Goodluck Jonathan.

“These 21 vehicles are presented to GSG to support the re-election campaign of our dear president and to the glory of God,” Chukwuma said.

Receiving the keys of the vehicles, the National Coordinator, GSG, Prof. Rufai Alkali, promised that they would be used to canvas for people’s vote for Jonathan toward 2015 general elections.

“We are very happy for the donation of these 21 vehicles which will help the GSG to effectively campaign for Dr Goodluck Jonathan before the February 2015 elections.

“I want to say that the GSG will do everything possible in every nook and cranny of Nigeria to make sure that Nigerians vote for Jonathan,” Alkali said.

Alkali assured the company that the Jonathan administration would continue to encourage the use of locally manufactured vehicles in Nigeria.

‘Loyal’ Reps Members Move To Oust Speaker Aminu Tambuwal

There are indications that the House might reconvene within the next one week to take further actions over Tambuwal’s defection and move for his ouster.

The decision to reconvene the House was one of the outcomes of the meeting between Jonathan and some principal officers of the House and PDP leaders.

The principal officers were the Deputy Speaker, Mr. Emeka Ihedioha; the Majority Leader, Mulikat Akande-Adeola; and the Deputy Majority Leader, Mr. Leo Ogor.

By enabling provisions, the House requires the approval of one-third of the total number of 360 members to reconvene the House.

A source at the meeting  Thursday, said, “What will happen is that about 120 members will sign and pass over to the speaker, asking that the House should be reconvened. That is what is going to happen in the next one week.”

Before now the House members who have been Loyal to the speaker after the meeting by the PDP are moving against him, one of the key officials said.

“This is politics and nothing personal, if the Speaker has defected, why not step aside as speaker knowing that the ruling PDP is to hold the mantle of the position he obviously doesn’t want to let go”?

He continued, “I don’t know what you mean by we’ve been loyal to him, yes we’ve enjoyed his leadership and that has nothing to do with changing political parties and sitting tight to the office that the PDP provides, on that of course as politicians we disagree with him”

Meanwhile, the All Progressives Congress, APC has accused President Jonathan of planning to reconvene the house following the withdrawal of Tambuwal’s aides.

The statement reads thus: “The All Progressives Congress rejects this challenge to democracy and modern society. We reject President Jonathan’s illegality and call for respect and compliance with the law. We reject this meddling in the affairs of the Legislature especially given the resolution of President Jonathan and his close advisers yesterday at their meeting to ask the Deputy Speaker Emeka Ihedioha to unlawfully reconvene the House before the adjourned date.

Tambuwal Reacts To Withdrawal Of His Security Details, Says Its Unconstitutional

The Speaker of the House of Representatives, Hon. Aminu Tambuwal, on Thursday accused the Acting Inspector-General of Police, Suleiman Abba, of breaching the 1999 Constitution by withdrawing the speaker’s police security personnel.

In a statement issued  by his media aide Imam Imam, Tambuwal said the withdrawal is contrary to the spirit and letters of the Nigerian constitution.

“We are on authority that nothing in the 1999 Constitution nor the Police Act confers on the police force adjudicatory powers including the interpretation of the constitution.

“In any case even Section 215 of the 1999 Constitution does not contemplate the issuing of or compliance with unlawful orders by the President and or the the Inspector General of Police respectively.

“What the Acting Inspector-General of Police has done therefore has no basis in law including the 1999 Constitution which he has cited. It is a brazen act of crass impunity, gross constitutional breach and contempt of court. The Inspector-General should desist from assuming or usurping the constitutional functions of the Judiciary,”
“For the avoidance of doubt, the question of whether or not there is a division or faction in the PDP has been resolved by Lord Justice Faji of the Ilorin Division of Federal High Court in suit FHC/ABJ/CS/605/2013, in which the court held that indeed there were factions in the PDP.

“Again, in suit no FHC/ABJ/CS/ 605/2013, the Sokoto Division of the Federal High Court per Justice Aikawa, the judgment of the court was that there was not only division but faction in the PDP, which later merged with the APC,”  

Stop Campaigning At IDPs Camps – NOA Warns Borno Politicians

The Borno state office of the National Orientation Agency on Thursday warned politicians to stop taking their campaigns to numerous internally displaced persons’ camps in the state.
Towns and villages in the state have been run over by Islamic group, Boko Haram with many families rendered homeless as a result.

The State Director, Alhaji Yahya Imam gave this warning in a chat with journalists in Maiduguri. He noted that some politicians have turned the Internally Displaced Persons’ camps to political rally grounds under the guise of donating relief materials for the traumatized people.

He insisted that this is not accepted especially as the ban on political campaign still stands.
“The ban on political campaigns were yet to be lifted by INEC and even if it was, it is ungodly to campaign to people who were suffering from physical and psychological pains at this point in time.

“NOA is calling on all displaced persons to remain united, apolitical and show love to one another during these trying moments in the camps.

“IDPs camps should be spared of political activities of all kinds as victims are expected to be united in continuous prayers for peace and unity to reign in the state,” he said.

Jonathan Intervenes In The NFF Crisis, Orders Reinstatement Of Coach Keshi

President Goodluck Jonathan has ordered the reinstatement of Former Super Eagles manager Stephen Keshi to oversee the two remaining 2015 Africa Cup of Nations qualifying matches.

The President was believed to have given the orders during his meeting with the bosses (Chris Giwa and Amaju Pinnick) of the two factions of the Nigeria Football Federation at the Aso Rock Villa yesterday where he asked them to resolve all issues between them by next week and should be sent a report.

Jonathan at the said meeting also asked Chris Giwa to vacate the court case in Jos, Plateau State, and ordered the immediate return of Keshi who has endeared the President since his nations cup win last year.

Keshi on stepping aside has said Nigeria “an unserious football country” after his departure earlier this month.

The Super Eagles will face Congo and South Africa next month in the remaining matches that would determine whether the reigning African champions would qualify for next year’s tournament.

Meanwhile, the court case against Nigeria’s football association that threatened to earn the country a lengthy ban from international competition has been dropped, lawyers said on Thursday.

The case had been brought by Chris Giwa, who was appointed to head the Nigeria Football Federation (NFF) in controversial circumstances in August but then later ousted.

A judge in Jos had last week ruled that the appointment of a new president, Amaju Pinnick, and executive committee should be set aside. But a fresh hearing on Thursday was told that Giwa had now withdrawn his complaint.

“I have struck out the matter… The suit ceases to have life,” said judge Ambrose Allagoa.

Giwa’s lawyer Habila Ardzard said the decision had been made “as a result of pleas from so many well-meaning Nigerians and in the national interest”.

Joshua Onoja, representing the NFF, also confirmed that the case had been discontinued. Football’s world governing body FIFA had given African champions Nigeria until midday on Friday to overturn the court ruling and reinstate Pinnick or face a ban from international competition.

The threat came because FIFA statutes prevent football issues from being heard in a civil court. FIFA has in recent months repeatedly warned Nigeria that it faced sanctions over the running of the NFF and its handling of elections to appoint a new president and executive committee.

“Restore Tambuwal’s Security” APC Calls On Jonathan For Better Understanding Of Democracy

The All Progressives Congress has called on President Goodluck Jonathan to show better understanding of democracy by immediately restoring the police security details the Inspector General of Police unlawfully withdrew from the Speaker of the Federal House of Representatives, Rt Hon Aminu Waziri Tambuwal.

In a statement issued in Abuja on Thursday by its National Publicity Secretary, Alhaji Lai Mohammed, the party described the announcement of the withdrawal of the Speaker’s security details by the Inspector General of Police as a usurpation of the role of the Judiciary by the Inspector General of Police especially bearing in mind that the question of the interpretation of Section 68(1)(g) of the Constitution on which the Inspector General of Police anchored his illegal act is currently before the courts for resolution.

The party said for avoidance of doubt the position including the manner a person becomes the Speaker of the House of Representatives is to be found in the Constitution, and no constitutional provision or legislation says membership of the ruling or dominant party in the House is a pre-requisite. Furthermore as the number four citizen of the Federal Republic of Nigeria the security detail and apparatus attached to the person of the Speaker is not based on his lineage, person and or political leaning. It is on account of the position and the protection required for that position and in Nigeria’s best interest.

This unfortunate use and deployment of Nigeria’s security forces in a partisan and political way portends danger and further weakens important institutions of governance and jeopardizes national security. Under President Jonathan, we now have a Police Force that is monitoring and making conclusions with respect to party membership, qualification, of an otherwise elected official. This is unheard of in any decent democracy.
It is unfortunate, the party noted that President Jonathan who had been a successive long term and unique beneficiary of our democracy and Constitution is now demonstrating the greatest disregard for the laws that govern and guide us as a people. President Jonathan who is the only individual who benefited from the same Constitution to become a Governor from a Deputy Governor without an election and from a Vice President to President in similar legal circumstances now desecrates the same Constitution.

The All Progressives Congress rejects this challenge to democracy and modern society. We reject President Jonathan’s illegality and call for respect and compliance with the law. May we remind President Goodluck Jonathan that under the House Rules only a resolution by all principal officers of the House and not even the Speaker of the House can reconvene the House before the adjourned date not to talk of the Deputy Speaker.

Lagos Police Command Deploys Officers To Igando Over Robbers’ Threat

The Lagos State Commissioner of Police, Mr Kayode Aderanti, on Thursday said he had deployed policemen and resources in Ikotun-Igando area over the alleged robbers’ threat to the community.

The CP was reacting to a letter purportedly sent to residents around College Bus Stop, Ikotun Road, Igando-Lagos, that they would come and attack them. The robbers had told the residents in the letter to prepare for their arrival and make ready their christmas gifts

“Within the past 24 hours, what we are doing in that area is unprecedented. I have deployed men and resources to that area.

“We have been able to stop that rumour, to me it is a rumour,” Aderanti said.

He urged the residents of the area to go about their daily activities and also solicited for any information that may assist the police investigation on the alleged letter.

Apple CEO Tim Cook came out as gay Thursday and said that fighting for equality is at the core of his personal and business ethos.

The head of the tech giant said his sexuality has never been a secret at his company, but acknowledging his homosexuality as a public statement about equality was “more important” than his privacy.

“Let me be clear: I’m proud to be gay, and I consider being gay among the greatest gifts God has given me,” Cook said in a statement in Bloomberg Businessweek.

“I’ve had the good fortune to work at a company that loves creativity and innovation and knows it can only flourish when you embrace people’s differences. Not everyone is so lucky,” he said.

The Apple CEO said coming out was part of his personal fight to stand up for minorities, a value he said his company also embraces.

“Part of social progress is understanding that a person is not defined only by one’s sexuality, race, or gender,” he said.

“Being gay has given me a deeper understanding of what it means to be in the minority and provided a window into the challenges that people in other minority groups deal with every day.”

“We’ll continue to fight for our values, and I believe that any CEO of this incredible company, regardless of race, gender, or sexual orientation, would do the same.

“And I will personally continue to advocate for equality for all people until my toes point up.”

Cook took over as the head of Apple in 2011 after the death of former CEO Steve Jobs.

He has faced criticism for not maintaining Apple’s lustre after the death of Jobs, who was hailed by fans as a visionary.

But the recent frenzy over the big screen iPhone 6 launch had some analysts applauding Apple’s comeback as it seeks to carve out its niche in the increasingly popular “phablet” market.

Cook said that being gay was only part of his identity, and described himself as a “an engineer, an uncle, a nature lover, a fitness nut, a son of the South, a sports fanatic, and many other things.”

He said he is inspired by civil rights champions Marin Luther King and Robert Kennedy, whose portraits hang in his office.
