Alleged defilement: ‘Baba Ijesha’, opens defence, drops no-case submission

Nigerian actor and singer, James Olanrewaju Omiyinka, stage name Baba Ijesha was arrested on April 22, 2021, for alleged rape of a minor under the care of Princess, a Nigerian actress and comedian (real name Damilola Adekoya)

He was charged on six counts of sexual assault by penetration, indecent treatment of a child, and sexual assault, which contravene sections 259, 135, and 261 of the Criminal Law of Lagos State 2011, as well as 135, 263, and 262 Criminal Law of Lagos State 2015.

There have been multiple trials since the onset of the case but in December of 2021, the defence intended to file a no-case submission and the case was adjourned until January 26, 2022, for adoption of the no-case submission.

However, defendant’s counsel, O. Alo, notified the court that the defendant had decided to enter into defence and would no longer be filing a no-case submission.

“We did not file a no-case submission again. In view of the development, we pray the court to give us a date.”

“Both senior lawyers representing the defendant are not in court, although Babatunde Ogala had informed Mr Awosika that he would not be in court today. Mr Awosika is indisposed; he didn’t know that he would not be able to be in court. We apologise, my Lord.” He said.

The case has however been adjourned till February 17 and 18, 2022, for defence in The Lagos State Special Offences Court.
