Justice Adeniyi Ademola of the Federal High Court Abuja has ordered the Independent National Electoral Commission (INEC) from conducting the governorship bye election scheduled to hold on October 11.
The election was supposed to fill the vacant seat of the Governor of the state with the major contenders being the Acting Governor of the state Umaru Finitri and APC candidate senator Jubrilla Bindow.
The however, ordered INEC to stop all preparation and the conduct of the election itself because there was no vacancy to be filled by the election.
The court held that the purported resignation of former Deputy governor Bala Ngilari was invalid since it violated the provisions of section 300 (1) (2) and (5) of the 1999 constitution haven been addressed to the speaker of the house of Assembly instead of the Governor.
The court then ordered that Bala Ngilari be sworn in immediately as the substantive governor of the state till May 29, 2015.
